General Terms of Use

Last updated: 10 October 2026

*The German version of this document is the authoritative one. This is a convenience translation.*

1. Provider and scope

The provider of the iOS app "Gutline" (the "app") is

Maximilian Kuchlbauer
Flurstr. 1
84524 Neuötting
Germany
Email: maximilian.kuchlbauer@gmail.com

These terms govern the use of the app between the provider and the user. They apply in the version available at the time the contract is concluded. Deviating terms of the user do not apply.

2. Description of the service

The app is a personal diary for digestive symptoms. It lets the user record severity, stool type on the Bristol scale, symptoms, tags and triggers, notes, photos, meals, drinks and habits, and a medication and therapy plan. It shows trends, averages and comparisons over the user's own entries and can produce a PDF report and a CSV file.

The app stores all data locally on the user's device. There is no user account with the provider, and no registration is required.

The scope of the app corresponds to the version currently published. The provider continues to develop the app and may change, add or discontinue individual functions, as long as the core benefit under the contract, keeping and reviewing one's own diary, is preserved.

3. Contracting party for purchases, Apple as seller

The app and the paid unlock "Gutline Pro" are distributed exclusively through the Apple App Store. The purchase contract for the app and for every in-app purchase is formed between the user and Apple. To that extent Apple is the seller and contracting party ("Merchant of Record").

The provider receives from Apple neither payment nor bank details of the user, only aggregated sales statements. For the purchase process, billing, refunds and subscription management, Apple's terms therefore apply in addition.

4. Gutline Pro, trial and prices

"Gutline Pro" is an auto-renewing subscription in three durations:

A person who newly installs the app reaches the diary, after the introduction, through the purchase screen on which Gutline Pro is offered. Gutline Pro includes unlimited entries per day, the 14 and 30 day ranges in the trends, the comparison of tags with symptoms, the PDF report, the CSV export, photos on entries, the lock with Face ID or passcode, and the daily reminder.

A free trial may be offered with individual durations. Whether there is one and how long it is, the purchase screen shows before purchase, and it applies only if the Apple ID is still eligible. Any unused portion of a trial is forfeited when a subscription is purchased. If the trial is not cancelled at least 24 hours before it ends, the paid subscription begins.

The current prices are shown in the app before purchase. The prices shown in the App Store at the time of purchase apply, including statutory value added tax. Payment is charged to the user's Apple account at confirmation of purchase. Subscriptions renew automatically for the duration booked unless cancelled at least 24 hours before the end of the current period.

Without an active subscription, for example after one has ended or for users of an earlier free version of the app, all entries already recorded stay readable. Up to three new entries per day can then be created, and the trends show the last seven days. Entries already saved are neither locked nor removed when a limit is reached.

5. Cancelling subscriptions

Subscriptions are managed and cancelled through the user's Apple account. Cancellation is possible at any time and without giving reasons, effective at the end of the current billing period, through subscription management in the device settings (Settings, Apple ID, Subscriptions). Deleting the app does not cancel the subscription.

After cancellation the booked access remains usable until the end of the period already paid. There is no pro rata refund for the unused remainder of a current period unless mandatory law provides otherwise. Entries already recorded stay on the device after cancellation.

6. Right of withdrawal

Consumers have a statutory right of withdrawal. Because the purchase contract is formed with Apple, the right of withdrawal is exercised against Apple, in particular through https://reportaproblem.apple.com. Details are in the separate withdrawal notice at https://mk-sd.com/en/gutline/withdrawal.

7. Right of use

The user receives a simple, non-transferable, non-sublicensable right to use the app on the devices assigned to them for their own private purposes. Resale, rental and use for third parties are not permitted.

Also not permitted are decompiling, reverse engineering or modifying the app unless the law expressly allows it, and attempts to circumvent the paid unlock.

All rights in the app, its source code, its design, its texts and its name remain with the provider.

8. Duties of the user

The user is responsible for the data they enter. Because the data is stored only locally on the device, the user is also responsible for backing it up, for example through the device backup or the CSV export. In case of loss, defect, reset or uninstallation without a prior device backup, the data cannot be restored. The provider has no copy.

If the user passes a report or file on to third parties, for example to a doctor, this is done on the user's responsibility and by the user's decision.

9. Availability

The app is provided as a locally running application and needs no server connection of the provider for its core functions. A connection to Apple is needed for prices, purchase and checking the unlock. No particular availability of the App Store, of Apple's system services or of future updates is owed. The provider may discontinue further development and support of the app.

10. Health notice

The app is a tool for documentation. It is not a medical device and replaces neither medical advice nor a diagnosis or treatment. It **does not assess any symptom, makes no diagnosis, recommends no treatment, medication, dose or diet** and does not say which trigger caused a symptom. Charts, averages, comparisons and notes about days with or without certain tags or plan entries are calculation rules over inputs the user made themselves. They describe what was entered, not a cause and not a state of health.

The user decides on their diet and treatment on their own responsibility. For persistent or new symptoms, blood in the stool, severe pain, fever, unintended weight loss or in case of doubt, medical advice must be sought, and in an emergency the emergency services. A change of diet, such as an elimination diet, should be accompanied by a doctor or a dietitian.

11. Liability

The provider is liable without limitation

For simple negligence the provider is liable only for breach of a material contractual obligation, that is, an obligation whose fulfilment makes proper performance of the contract possible in the first place and on whose observance the user may regularly rely. In that case liability is limited to the damage foreseeable at conclusion of the contract and typical for this type of contract.

Otherwise the provider's liability is excluded. This applies in particular to loss of data, to lost profit, to indirect damage and to damage resulting from improper use, from the user's missing data backup or from causes outside the provider's sphere of responsibility, such as disruptions of the App Store, Apple's system services or the device itself.

For loss of data the provider is also liable only to the extent that the damage would have occurred even with proper and regular data backup by the user.

The above limitations of liability also apply in favour of the provider's legal representatives and vicarious agents.

12. Data protection

Details on the processing of personal data are in the privacy policy, available in the app under Settings and at https://mk-sd.com/en/gutline/privacy.

13. Changes to these terms

The provider may change these terms where this is necessary to adapt to a change in the law, to changed supreme court case law, to technical development of the app or to changed requirements of the App Store, and the user is not unreasonably disadvantaged by it.

The user is informed of material changes in the app. If the user does not object to a material change within six weeks of the information, or keeps using the app afterwards, the change is deemed accepted. The meaning of silence is pointed out separately in the information. If the user does not agree with a change, they can cancel a running subscription at the end of the current period.

14. Relationship to Apple's terms

Distribution is exclusively through the App Store. In addition to these terms, Apple's terms therefore apply, in particular the Apple Media Services Terms and Conditions and the Licensed Application End User License Agreement (https://www.apple.com/legal/internet-services/itunes/dev/stdeula/). Where these terms and Apple's terms contradict each other, Apple's terms prevail for the purchase process, billing, refunds and subscription management.

For the use of the app the following also applies:

15. Final provisions

German law applies, excluding the UN Convention on Contracts for the International Sale of Goods. Mandatory consumer protection provisions of the state in which the user has their habitual residence remain unaffected.

Should a provision of these terms be or become invalid, the validity of the remaining provisions remains unaffected.

The provider is neither obliged nor willing to take part in dispute resolution proceedings before a consumer arbitration board.

*These terms describe the state of the Gutline app on the date above. They are not legal advice and do not replace a review by a lawyer.*
