Right of Withdrawal

FoodNoteBook is sold through two paths, with a different contracting party: through the Apple App Store, and through the FoodNoteBook website with the payment processor Stripe. Which of the two parts below applies to you depends on where you subscribed to "FoodNoteBook Pro".
Part 1: Purchase through the App Store
Important note on the contracting party
The purchase contract for the "FoodNoteBook Pro" subscription, when bought through the Apple App Store, is concluded **between the user and Apple**, not with Maximilian Kuchlbauer. The statutory right of withdrawal for this purchase contract, as digital content or a digital service, therefore exists primarily against Apple and is exercised through the channels Apple provides, including https://reportaproblem.apple.com and the Apple ID purchase history.
This notice is nonetheless provided for information and as a precaution, in case the operator of this app is also considered an addressee for withdrawal in some specific constellation.
The § 356a BGB cancellation button
§ 356a BGB (German Civil Code) requires an electronic withdrawal function ("withdraw from contract") where a consumer contract in electronic commerce is concluded through an online interface and a statutory right of withdrawal exists. For the App Store path, this duty falls on Apple, not the operator of this app: FoodNoteBook provides no purchase or order interface of its own for the App Store path, it only triggers Apple's own StoreKit purchase dialog, and the contract is concluded with Apple. The electronic withdrawal function is therefore provided and operated by Apple, in particular through https://reportaproblem.apple.com and the Apple ID account's purchase history.
Part 2: Purchase through the website (Stripe)
If you subscribe instead through the account settings on the FoodNoteBook website, the operator of this app is your contracting party, and the right of withdrawal below exists directly against the operator, not against the payment processor Stripe.
Right of withdrawal
Consumers have the right to withdraw from this contract within fourteen days without giving a reason.
The withdrawal period is fourteen days from the day the contract was concluded.
To exercise your right of withdrawal, you must inform us of your decision to withdraw from this contract by an unambiguous statement (for example a letter sent by post or an email). Our contact details:

To meet the withdrawal deadline, it is sufficient to send your communication concerning the exercise of the right of withdrawal before the withdrawal period has expired.
Effects of withdrawal
If you withdraw from this contract, we shall reimburse to you all payments received from you without undue delay and no later than fourteen days from the day on which we received notice of your withdrawal from this contract. For this reimbursement, we will use the same means of payment you used for the original transaction, unless expressly agreed otherwise with you. Because payment is technically processed through Stripe, reimbursement is likewise made through Stripe.
Early expiry of the right of withdrawal
For a contract to supply digital content not delivered on a physical medium, the right of withdrawal expires if you have expressly agreed that we begin performance of the contract before the withdrawal period has expired, and you have confirmed your knowledge that, by giving that consent, you lose your right of withdrawal once performance begins.
By completing the payment on the website and the immediate unlocking of Pro features, you give that consent.
§ 356a BGB: the cancellation button for the website path
Because the operator itself operates the online interface through which the contract is concluded here, the operator is subject, for this path, to the duty under § 356a BGB to provide an easily accessible, clearly visible electronic withdrawal function, available throughout the entire withdrawal period. The operator provides access to subscription management for this in the account settings on the website. **Whether the wording there already meets the specific formal requirement of § 356a BGB in every respect could not be conclusively established as part of this review**, and is noted as an open item in README.md in this directory; until that point is resolved, withdrawal can in any case be declared informally by letter or email to the contact details above.

Exclusions/special features for subscriptions
For running subscriptions, the following also applies: ordinary cancellation at the end of the respective term is always possible independently of the right of withdrawal, through Apple ID subscription management for the App Store path, or through the account settings on the website for the website path (see Terms of Use, sections 3.1 and 4.1 respectively).
