Right of Withdrawal

Important notice about the contracting party

When you buy the Sixteen Pro subscription through the Apple App Store, the purchase contract is concluded between you and Apple, not with Maximilian Kuchlbauer. Apple is the seller and merchant of record for every App Store purchase (see the Terms of Use, section 3). The statutory right of withdrawal for that purchase, as a contract for digital content or a digital service, therefore exists primarily against Apple and is exercised through the channels Apple provides:

This document is nonetheless provided for information, and as a precaution, in case the provider of this app is also a proper addressee for withdrawal in some particular situation. German law (§ 356a BGB, in force since 19 June 2026, implementing EU Directive (EU) 2023/2673) requires an electronic withdrawal button on the online interface through which a consumer contract is concluded. Sixteen does not operate its own purchase interface: it only triggers Apple's StoreKit purchase dialog, and the contract is concluded with Apple, which operates that interface.

Right of withdrawal

Consumers have the right to withdraw from a contract for digital content or a digital service within fourteen days, without giving reasons.

The withdrawal period is fourteen days from the conclusion of the contract.

Early expiry of the right of withdrawal

The right of withdrawal expires early if performance of the contract (for example, unlocking the Pro features, or download) has begun after the consumer has

  1. expressly agreed that performance may begin before the withdrawal period ends, and
  2. confirmed their knowledge that, by giving that agreement, they lose their right of withdrawal once performance begins.

In the Apple App Store purchase flow, this agreement is represented technically by Apple's purchase confirmation dialog.

Consequences of withdrawal

If withdrawal is effective, both parties must return what they received; amounts already paid are refunded. Because payment is processed through Apple, any refund is made by Apple.

Subscriptions

For a running subscription, ordinary cancellation effective at the end of the current period is available at any time through your Apple Account subscription management, independent of the right of withdrawal (see the Terms of Use, section 5, and the "Manage subscription" link in the app).

This document covers only the right of withdrawal as a consumer protection instrument (German Civil Code and the EU Consumer Rights Directive). It does not replace the ordinary cancellation of a subscription at the end of its term.
